AFLW Fantasy by Moreira’s Magic 2023 - TERMS & CONDITIONS

AFLW Fantasy by Moreira’s Magic ("AFLW Fantasy") is an online fantasy sports competition based on the real life performances of players in the Australian Football League – Women (“AFLW”). This Website ("Website") is operated by Fantasy Sports by MM Pty Ltd ACN 654 830 565 (“Company”).

The Company and the Website are not endorsed by or affiliated in any way with the Australian Football League, the AFLW or the official AFL Fantasy website.

Please read these Terms & Conditions carefully before accessing or using the Website. By registering and participating, users (“you”) agree to be bound by these terms and conditions.

1. WHO MAY PLAY

Entry requirements

1.1. Entry to AFLW Fantasy is open to anyone. However, only certain entrants (described below) may be eligible to win and claim a prize.

1.2. Entrants under 18 years of age at the time of entry must seek their parent or guardian’s permission prior to entering the competition (including consenting on the entrant’s behalf to these terms and conditions). Any Prizes that may be won by an entrant under 18 years of age will be awarded to their parent / guardian.

Eligibility to win a prize

1.3. The following entrants are welcome to enter, but are not eligible to win any prizes for their participation in AFLW Fantasy:

    i. participants who are not Australian residents for the duration of the AFLW Season 2023;
    ii. employees of any companies involved in this competition;
    iii. participants who are registered players or game day officials (coaches and umpires) of the AFLW for the 2023 AFLW Season;
    iv. Employees of the AFLW company associated with the collection of the official statistics for AFLW (currently Champion Data Pty Ltd ACN 073 008 063)

1.4. AFLW Fantasy is offered as a free game to all participants. All entrants and competition winners consent to the publication of their name and state of residence (but not their full address) to be publicly displayed on the Website. The Company reserves the right to limit the number of participants in AFLW Fantasy at any time for any reason.

2. TERM OF COMPETITION

2.1. AFLW Fantasy will be conducted during the 2023 AFLW home and away season ("AFLW Season 2023"). The competition period commences at 12:01AM (AEDT) on 27 July 2023 and ends at 11:59PM (AEST) on the Monday following the last match for the AFLW regular Season, currently estimated to be Monday 6 November 2023. The Company reserves the right to cancel the AFLW Fantasy competition at any time for any reason.

3. HOW TO ENTER

Registration

3.1. To enter, participants must complete the online registration form via www.aflwfantasy.com.au/registration

3.2. There are no charges for registration and participation is absolutely free.

3.3. Once registered, participants are required to:

    (i) Select an eligible AFLW Fantasy side within the salary cap and positional restrictions described on the Website;
    (ii) Play and maintain their AFLW Fantasy side in accordance with these official rules.

3.4. Participants must register under the actual name and can only enter AFLW Fantasy once. Under no circumstances can participants enter two or more teams in AFLW Fantasy. Any entrant who enters two or more teams in AFLW Fantasy, or is suspected to be operating multiple teams at any time, will be ineligible to win any prizes in respect of all their teams.

3.5. Any entry that fails to provide all required information (or if the Company believes any such information to be false) may be disqualified. The Company assume no responsibility for incomplete, late or misdirected entries, or entries received through impermissible or illegitimate channels or for failed, partial or garbled computer transmissions, or for technical failures of any kind. The Company reserve the right to disqualify any entrant submitting an entry which is not made in accordance with the terms of these official rules or who does not abide by the Website terms and conditions.

3.6. AFLW Fantasy teams are not transferable. Entrants must not transfer or sell any team or purport to or offer to transfer or sell any team.

4. SCORING OF POINTS

Team selection and salary cap

4.1. Each participant chooses a team of 21 players within the salary cap restrictions described on the Website.

4.2. Teams must be selected according to the following positional requirements:

    i. 6 defenders (5 on field, 1 on the interchange bench)
    ii. 6 midfielders (5 on field, 1 on the interchange bench)
    iii. 2 rucks (1 on field, 1 on the interchange bench)
    iv. 6 forwards (5 on field, 1 on the interchange bench)
    v. 1 utility (a player from any position who will be on the interchange bench)

Player positions on the Website are determined by the Company and will not change throughout the season. There is no guarantee the player positions on the Website reflect that of the real life performances of each player.

4.3. Each round, the 16 players selected on the field will contribute to a participant's AFLW Fantasy Score is based on the player's AFLW Fantasy Score in that round as per the official https://www.womens.afl/ website.

4.4. In addition to the 16 starting players, four of the five players on the interchange (one defender, one midfielder, one ruck and one forward) will have a score that does not count unless they replace a starting player (i.e. a member of the 16 listed on field) in the same position who did not play that round. The fifth interchange player is a utility, meaning they can be selected from any position. The utility’s score will not count unless a starting player does not play AND the interchange player listed in the relevant starting players’ position (DEF, MID, RUC or FWD) also does not play. The utility can fill in any position should the starting player and corresponding interchange player not play, regardless of what position the utility and the starting player are classified as. For example, if a player in your forward line does not play in a particular round, and the forward interchange player also does not play in that round, then the utility’s score will count as a forward, even if she is classified in a position other than forward. Note: the utility can only fill in for a starting player once in a round, so if a team has multiple starting players and their corresponding interchange player does not play, the utility score will only fill in for one starting player.

AFLW Fantasy Format, Captains and Rounds

4.5. Points are only scored by players selected for each game/round (in accordance with the “AFLW Fantasy / Dream Team Scoring System” below). After selecting their starting 16 players, participants must choose a team Captain who will score double points for the round. Participants may also choose a Vice-Captain, who will score double points for the round if the selected captain does not, for any reason, play that round.

Trading

4.6. Participants can replace up to 3 members of their squad each week via the Trade page of the Website. Participants can make up to 30 trades per season (3 per week for the 10 Rounds). However, trades cannot be accumulated as there is a maximum of 3 per Round, meaning if a participant uses less than 3 Trades on any given Round, they lose any unused trades. Trades must be made prior to the commencement of each AFLW Round (as notified on the Website via the Lockout countdown) and will be subject to the participant's AFLW Fantasy Salary cap.

Players traded during the season do not get their aggregate points added or subtracted to the participant's total when the player is not in the participant’s team.

4.7. Player values can be found on the Team, Trade and Player Stats pages of the Website. The values and price changes are fictitious and are determined by the Company based of a number of factors, including draft history, historical performances, games played and total number of points scored for the round. All players who play over any given round will be subject to price changes, determined by the Company. If a player does not play in a round for any reason, their price will not change.

AFLW Fantasy Scoring System

4.8. Individual player scores are awarded as per the following table, based off their real life statistics for the round:

A participant’s overall team score is equal to the total of the 16 players in a participant's AFLW Fantasy starting line-up, including double score for the participant’s selected captain (or vice captain should their captain not play) plus any eligible interchange player who replaces a non-playing player in the starting line-up).

The determination of the individual Fantasy scores will be as per the player's AFLW Fantasy Score in that round as displayed on the official https://www.womens.afl/. If for some reason player statistics are updated on the https://www.womens.afl/ website after the lockout has been lifted, these changes will not be amended in AFLW Fantasy, all player scores are final as of lockout. The Company accepts no responsibility for any disputes, late adjustments or inconsistencies of the final statistics and cannot guarantee there won’t be any mistakes made.

5. DETERMINATION OF WINNERS

5.1. During the competition period winners will be determined as follows:

    i. Round Prize Winners - Following the completion of all AFLW games for that round, the participant whose AFLW Fantasy team has earned the highest number of points for that round will be declared the Round Prize winner. In the event more than one team scores the highest number of points, the team with the most total points will be determined the Round Prize Winner. Where a tie cannot be resolved by any of the means above, the most total points leading into the prior round will be determined to Overall winner. This process will repeat itself until a winner is determined. If a winner still can’t be determined, the participant whose AFLW Fantasy team was registered the earliest will win.
    ii. Competition Major Prize Winner - At the completion of the competition period of the AFLW Season 2023, the participant whose AFLW Fantasy teams have earned the highest number of points for the entire season will be declared the Competition Major Prize Winner. In the event more than one team scores the highest number of points, the team with the most total points leading into the final round will be determined to Overall winner. Where a tie cannot be resolved by any of the means above, the most total points leading into the prior round will be determined to Overall winner. This process will repeat itself until a winner is determined. If a winner still can’t be determined, the participant whose AFLW Fantasy team was registered the earliest will win.

5.2. The Company’s decision in respect of any prizes is final and no correspondence will be entered into.

6. PRIZES

Prizes for AFLW Fantasy Season 2023 will be announced shortly.

7. TAX STATEMENT

7.1. The Company accept no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. Where the operation of this competition results in, for GST purposes, supplies being made for non-monetary consideration, entrants agree to follow the Australian Taxation Office's stated view that where the parties are at arm's length, goods and services exchanged are of equal GST inclusive market value.

8. EXCLUSION OF LIABILITY

8.1. To the extent permitted by law, the Company is not liable for any loss suffered or sustained to person or property, including, but not limited to, consequential (including economic) loss, by reason of any act or omission, deliberate or negligent while playing AFLW Fantasy.

8.2. Nothing in these official rules affects, nor is intended to affect, any rights a consumer might have which are not able to be excluded under applicable Australian consumer protection laws. To the fullest extent permitted by law, any liability of the Company for breach of any such rights is limited to the supplying of the relevant goods or services again.

9. GENERAL CONDITIONS

9.1. The Company, their employees and any related company of the Company, are not responsible for and shall not be liable for:

    (i) any condition caused by events beyond the control of the Company, that may cause the game to be disrupted or corrupted;
    (ii) any injuries, losses, or damages of any kind caused by a prize or resulting from acceptance, possession, use, or misuse of a prize, or from participation in the game; or
    (iii) any printing or typographical errors in any materials associated with AFLW Fantasy.

9.2. The Company reserves the right, in its sole discretion, to cancel or suspend the competition, should virus, bugs, unauthorized human intervention, or other causes beyond the control of the Company, in its sole opinion, corrupt the administration, security, fairness, integrity, or proper operation of the game or to disqualify any entrant who engages in offensive, illegal or objectionable conduct. The Company reserves the right in its sole discretion to disqualify any individual who tampers with the entry process. The Company reserves the right in its sole discretion to amend these terms and conditions, or the operation of the game, at any time as a result of any unforeseen events or circumstances, or any causes beyond the control of The Company.

9.3. The Company may collect information about users, including for example a user’s name and contact details which users provide when registering your team in accordance with the Privacy Policy. The Company may disclose user information to our related companies and third party websites. The Company may also disclose user information to our service and content providers.

Further information about how the Company handles personal information, how users can make a complaint about a breach of the Australian Privacy Principles, how the Company will deal with a complaint of that nature, how users can access or seek correction of their personal information and the Company’s contact details can be found in our Privacy Policy at http://www.aflwfantasy.com.au/privacy/.

9.4. By accessing and using AFLW Fantasy, users consent to your personal information being used for the purposes set out above.

9.5 AFLW Fantasy is considered a game of skill and the total prize value does not exceed $10,000. AFLW Fantasy is not a game of chance and therefore is not required to have a Trade Promotion permit.

10. MAGIC UP

Magic Up contains information, analysis and other services and content intended to increase your enjoyment of the game. You do not need to Magic Up to play or win prizes in the game, and Magic Up does not increase your chances of winning the Games.

Magic Up content is provided by Moreira’s Magic Pty Ltd (ABN 73 647 253 290) (“Moreira’s Magic”) and the information is integrated into your AFLW account. Payment for Magic Up is charged by Moreira’s Magic.

Magic Up costs $9.95 upfront and access to the data will commence at the time of payment until the end of the AFLW Season.

11.1 Refund Policy:

Moreira’s Magic stand behind their content and your satisfaction is important to them. Moreira’s Magic offers a 100% money-back guarantee. If for any reason you are not satisfied within 24 hours of purchasing Magic Up, simply send an email to [email protected] and they will refund your full purchase price and cancel your product subscription. After 24 hours, no refunds are accepted due to the nature of the time-sensitive product.

11.2 Payments and payment details

All information submitted by you to us (including the information in your application to become a Magic Up Member via Moreira’s Magic) is complete, true and accurate and any credit card or debit card details you provide in respect of a card issued to you or that you are authorised to charge the fees to.

All payments are made via a trusted third-party payment platform (stripe.com). Payments are made under the third party’s terms and conditions and AFLW Fantasy and Moreira’s Magic is not responsible for any payment issues.

We do not store any credit card, debit card or other similar details you provide to us outside of the Stripe system.

11.3 No Guarantees

You acknowledge that:

    i. as Magic Up contains information and analysis that relate to advanced statistics and the attempted prediction of future events or performances, we provide no guarantees or warranties that the Magic Up Content will be entirely correct, accurate, reliable or fit for any particular purpose;
    ii. Magic Up is not designed to, and does not, increase your chances of winning the AFLW Fantasy, but it simply provides you with centralised content that may enhance your experience.

12. FORCE MAJURE

12.1. We will not be liable for any delay or failure to perform any obligation under these terms and conditions insofar as the performance of such obligation is prevented by an event beyond our reasonable control, including but not limited to, a pandemic or epidemic, earthquake, fire, flood or any other natural disaster, labour dispute, riot, revolution, terrorism, acts of restraint of government or regulatory authorities, failure of computer equipment, ongoing internet or telecommunications outage or failure or delay of sources from which data relevant to AFLW Fantasy is obtained.

12.2. If for any reason, the AFLW Season 2023 is impacted by an event beyond our reasonable control, such as the COVID-19 pandemic, the Company may, in its reasonable discretion, pause or abandon AFLW Fantasy. Any Round Prize awarded prior to AFLW Fantasy being abandoned will remain valid. However, the Competition Major Prize will not be awarded unless all matches of the AFLW Season have been completed.

12.3. If a game is postponed, all players selected in that game will receive their Season 7 (2022A) season average. If the game is postponed prior to team announcements, averages will apply to those who played the round prior.

If averages are applied, prices will not change.

If a game gets postponed but is still played at least 24 hours prior to the commencement of the following round, the players’ score in the rescheduled game will still count and averages will not be applied.

12.4. Further changes to the competition can be at the discretion of the Company.

13. SERVER ISSUES AND OUTAGES

As access to AFLW Fantasy is provided using the internet, the Company does not provide any warranties or guarantees that AFLW Fantasy, and/or your access to Magic Up, will be free of outages, interruptions or other similar issues. We will do our best to keep the site working at all times.

14. TEAM NAMES AND OFFENSIVE CONTENT

Eligible Participants who upload content containing offensive or defamatory comments or team names, as determined by AFLW Fantasy, may be disqualified and have their entry removed at any time.

15. USER WELL-BEING

Fantasy sports is aimed to be communal, fun, and an escape from the burden of everyday life. However, fantasy sports can also cause angst, stress and disappointment at times. While we attempt to celebrate the fun component of fantasy sports via this competition, this website and the Moreira’s Magic website, there is no guarantee that you will not experience the burden and you do so at your own risk. You can remove your entry at any time via your account settings or emails us at [email protected]

16. SPONSORS

AFLW Fantasy may promote third party content on the Website, Podcasts or Social Media channels that has been paid for by the third-party company. These companies may not be applicable for people under the age of 18 and members should read the third party’s terms and conditions.
